Recent trends in business ethics along with growing attacks upon unions, suggest that employee rights will be a major social concern for business managers during the next decade. However, in most of the discussions of employee rights to date, the very meaning and legitimacy of such rights are often uncritically taken for granted. In this paper, we develop an account of employee rights and defend this conception against what we take to be the strongest in-principle objections to it.

This second festschrift for Robert Sokolowski brings together papers given in April 2000 at a colloquium on the occasion of his sixty-fifth birthday. In contrast with the first festschrift in honor of his sixtieth birthday, which was mostly phenomenological philosophy, the present collection is mostly phenomenological theology.

This paper examines the nature of ‘reasonable’ argumentation in Generation of Animals III.10. Its aim is to develop an alternative to the dialectical construal of reasonable argumentation in Aristotle recently favoured by Robert Bolton. On the basis of a close textual analysis I show that the reasonable arguments deployed in Generation of Animals III.10 do not appeal to endoxa or reputable beliefs per se. Instead, they rely upon general facts about animals established by empirical induction. This implies that, contra (...) Bolton, not all reasonable arguments in Aristotle are dialectical; some, in fact, are thoroughly empirical and scientific. I conclude by suggesting that such empirical reasonable arguments even have a place in the De Caelo, the treatise that Bolton primarily focused upon when developing his interpretation. (shrink)

RÉSUMÉ. — Robert Brandom a tenté de déplacer le concept de représentation de sa position de concept explicatif central en philosophie du langage et de le remplacer par un ensemble de concepts explicatifs dérivés de l’analyse de l’action sociale. Il soutient que le concept de norme sociale peut servir de concept primitif dans le développement d’une théorie générale de la signification. Selon Brandom, le problème central lié au fait de considérer la représentation comme un primitif explicatif est que nous (...) n’avons pas une compréhension claire de ce à quoi correspond la relation de « représentation ». Il est donc naturel de s’attendre à ce que Brandom utilise, dans son analyse de l’action sociale, des primitifs explicatifs qui sont, d’une certaine manière, moins mystérieux. En particulier, on s’attend à ce que Brandom démontre que le concept de « norme sociale » peut être compris en termes d’un ensemble plus simple de concepts issus de la philosophie de l’action. Malheureusement, Brandom ne fournit pas une telle explication. Dans cet article, je commence par analyser l’argument proposé par Brandom, et je tente d’expliquer pourquoi cet argument, en définitive, n’est pas concluant. Here are two meritorious and well-produced works devoted to the dialogue between Buddhism and Christianity. They also have in common a certain desultoriness which left me reflecting on the limits of the rhetoric of 'dialogue.' Having taken over from 'liberation' as a theological buzzword, 'dialogue' seems by now to have exhausted its usefulness. William James remarked that everything genuine will somewhere become a sham. Lip service to a vague ideal of dialogue becomes a substitute for the unmet challenge of Buddhist-Christian thought, and the less the dialogue is practiced the more its importance is verbally celebrated. The retention of the word 'dialogue' may even serve to keep the religious other at a comfortable distance: it is more reassuring to say, "Of course we are in dialogue with the Buddhists" than to say "We are facing up to the challenge Buddhist thought poses to Christian theology," for in the former statement the Buddhists remain conveniently located others, sitting across the table, rather than a troublesome, potentially subversive presence within our own intellectual world. [End Page 315]In their submission to the recent Roman synod of Asian bishops, the Japanese bishops made much of their commitment to interreligious dialogue, and this was acclaimed with enthusiasm. But the impression left by Karin Amell's book (a doctoral thesis in missiology) is that not very much is going on in this area in Japan, the country seen as "the promised land of dialogue" after Vatican II (p. 119). "One has the impression that it is an activity for a few specialists" (p. 145), leaving the ordinary faithful largely untouched. Amell apparently does not read Japanese, so there may be much that she has missed, yet for my part I can think of nothing to add to the factual content of her account. For the spiritual side of the encounter she focuses on three Japanese pioneers, now in their seventies (pp. 150-191): Kadowaki Kakichi, SJ, Okumura Ichiro, OCD, and Oshida Shigeto, OP. To what extent these men have succeeded in creating a widespread Catholic Zen culture remains unclear, but Amell believes the "dialogue of religious experience" is the most widespread form of Buddhist-Catholic interaction in Japan (p. 146). As to scholarship, which is not Amell's direct concern, one has the impression that everyone is too busy with church and university affairs to devote their time to this. The scholarly labors of Heinrich Dumoulin, for example, have not been continued by anyone else. Despite the work of a powerful Catholic foundation, the Nanzan Institute for Religion and Culture (p. 141), Buddhism does not seem to excite Catholic intellectuals in Japan. Japanese Catholics are a small community, numbering about half a million. But given the high number of theologians, clergy and religious (p. 137), one would expect a more intensive interaction with local religious traditions. Instead the focus of theological interest remains fixed on Western sources. It is not so much that the situation of a small church in the midst of secularized-polytheistic-Buddhist Japan fails to give food for thought as that people seem afraid to think out its implications. Those engaged in contemplative sharing with Buddhists seem to avoid intellectual issues. Amell is uneasy with the insistence on intuition and the latent anti-intellectualism she finds in the intermonastic dialogue (discussed in the first half... (shrink)

That two theories of law are different does not imply that they differ in all aspects. Far more likely is the opposite state of affairs, namely, that there are some common points along with some points of disagreement. I will start with three points in which there seems to be at least some connection between Joseph Raz’s opinions and my own. In a second step, I will consider what is, perhaps, the most fundamental difference.

Jewish historiographical production of the Renaissance and Baroque periods was in fact the expression of the unsuccessful attempt by a handful of individuals to make sense of Jewish history as a living history in diaspora conditions. Their failure was the inevitable result of the essential incompatibility of the subject matter of history, in those days conceived mainly as political and military narrative, and the destiny of their people the world over. Jewish historiographic output can be seen as part of the (...) Jewish endeavor to redefine Jewish identity at the dawn of the modern era. However, the time had not yet come for a "New History" among both Jews and non-Jews -attempted in particular by Joseph ha-Cohen, David Ganz, and most perhaps most successfully by Azariah de Rossi-which might have provided a possible answer to the crisis of Renaissance historiography. David Bohm, Emeritus Professor of Theoretical Physics at Birkbeck College of the University of London and Fellow of the Royal Society, died of a heart attack on October 29, 1992 at the age of 74. Professor Bohm had been one of the world’s leading authorities on quantum theory and its interpretation for more than four decades. His contributions have been critical to all aspects of the field. He also made seminal contributions to plasma physics. His name appears prominently in the (...) modern physics literature, through the Aharonov- Bohm effect , the Bohm-EPR experiment , the Bohm-Pines collective description of particle interactions (random phase approximation), Bohm diffusion and the Bohm causal interpretation of quantum mechanics, also sometimes called the de Broglie-Bohm pilot wave theory. David Bohm was born in Wilkes-Barre, Pennsylvania on December 20, 1917. A student of J. Robert Oppenheimer, Bohm received his Ph.D. from the University of California at Berkeley in 1943. In 1950 he completed the first of his six books, Quantum Theory, which became the definitive exposition of the orthodox (Copenhagen) interpretation of quantum mechanics. Here Bohm presented his reformulation of the paradox of Einstein, Podolsky, and Rosen. It is this Bohm version of EPR which has provided the basis for the enormous expansion of research on the foundations of quantum theory, focusing on nonlocality and the possible incompleteness of the quantum description (the question of “hidden variables”), which has occurred during the past several decades. In response to Stirrat and colleagues, this article seeks to highlight the mutual benefit that could be derived from an integration of human rights into the already established medical ethics and law teaching in medical schools. A crime was committed in France in 1793. They killed a good and entirely likable king who was the incarnation (...) of legitimacy. We cannot not remember that this crime was horrible... When we speak about writing, the accent is on what is necessarily criminal in writing. (Jean-François Lyotard, "Discussion Lyotard-Rorty" 583; quoted in Dunn 165) The condemnation ofthe king is at the crux ofour contemporary history. It symbolizes the secularization of our history and the disincarnation of the Christian God. (Albert Camus, The Rebel 120; quoted in Dunn 140) Susan Dunn makes a well-documented case that the death of Louis XVI was unconsciously understood, especially by the Jacobins, as a human sacrifice that was necessary for the founding of the republic. "Louis must die because the patrie must live," said Robespierre at the king's trial, and the representative Carra considered Louis "the source of corruption and servitude... the fatal talisman ofall our ills" whose death would cause the people to be "regenerated in morality and virtue" (Dunn 15-37). The king was a monster and the source ofall the ills, and his death 68Robert G. Hamerton-Kelly had the power to alleviate those ills and regenerate the nation. This image of the king as sacrificial victim persisted throughout the first half of the nineteenth century in French literature and politics, sometimes assimilating itself to the image of Jesus Christ who died for the sins of the world. Legitimist writers like Joseph de Maistre saw his death precisely in this light as a great Christian sacrifice that would do France and the world good (Dunn 28-37). The king as a sacred monster whose life causes all ill and whose death brings healing is the classic figure of the scapegoat or sacrificial victim identified by René Girard. Susan Dunn recognizes this but because she does not know Girard's mimetic theory she is not able to explain the significance of the scapegoat king. Her work is, indeed, as Conor Cruise O'Brien says in the foreword, a work ofdemonstration rather than argument, of evidence rather than interpretation. I offer a mimetic interpretation ofthe Jacobin claim that the death ofthe king was the human sacrifice that founded the republic, and an argument that a universally operative generative mechanism forged the historical events of the revolution.1 There is no essential difference between the sovereignty ofthe king and the sovereignty of the people. In both cases sovereignty arises from a metaphorical contract that threatens death to anyone who violates it. The royal metaphors are organic while the revolutionary metaphors are legal and rational, but they all express the sacrificial structure ofpolitical power. Revolutionary democracy imports the fiction ofrationality to obscure its sacrificial structure. The desire ofthe general will for contractual equality is a transformation of mimetic desire in search of a victim around which the bad violence ofmimetic rivalry can coalesce into the good violence of sacred order. Sovereignty, therefore, is structurally single and simple; it is violence transformed through the sacred into the powers oforder. Max Weber understood this in general ifnot in its particulars when he defined sovereignty as the monopoly of the means of violence within a single territory.2 1 Mimetic theory was discovered by René Girard. We report an experiment that unambiguously shows an effect of full-form frequency for fully regular Dutch inflected verbs falling into Clahsen's “default” category, negating Clahsen's claim that regular complex words in the default category are not stored.

When the COVID-19 surge hit New York City hospitals, the Division of Medical Ethics at Weill Cornell Medical College, and our affiliated ethics consultation services, faced waves of ethical issues sweeping forward with intensity and urgency. In this article, we describe our experience over an eight-week period (16 March through 10 May 2020), and describe three types of services: clinical ethics consultation (CEC); service practice communications/interventions (SPCI); and organizational ethics advisement (OEA). We tell this narrative through the prism of time, (...) describing the evolution of ethical issues and trends as the pandemic unfolded. We delineate three phases: anticipation and preparation, crisis management, and reflection and adjustment. The first phase focused predominantly on ways to address impending resource shortages and to plan for remote ethics consultation, and CECs focused on code status discussions with surrogates. The second phase was characterized by the dramatic convergence of a rapid increase in the number of critically ill patients, a growing scarcity of resources, and the reassignment/ redeployment of staff outside their specialty areas. The third phase was characterized by the recognition that while the worst of the crisis was waning, its medium- and long-term consequences continued to pose immense challenges. We note that there were times during the crisis that serving in the role of clinical ethics consultant created a sense of dis-ease as novel as the coronavirus itself. In retrospect we learned that our activities far exceeded the familiar terrain of clinical ethics consultation and extended into other spheres of organizational life in novel ways that were unanticipated before this pandemic. To that end, we defined and categorized a middle level of ethics consultation, which we have termed service practice communication intervention (SPCI). This is an underappreciated dimension of the work that ethics consult services are capable of in times of crisis. We believe that the pandemic has revealed the many enduring ways that ethics consultation services can more robustly contribute to the ethical life of their institutions moving forward. (shrink)

This article documents experiences of Glasgow Improvisers Orchestra’s virtual, synchronous improvisation sessions during COVID-19 pandemic via interviews with 29 participants. Sessions included an international, gender balanced, and cross generational group of over 70 musicians all of whom were living under conditions of social distancing. All sessions were recorded using Zoom software. After 3 months of twice weekly improvisation sessions, 29 interviews with participants were undertaken, recorded, transcribed, and analyzed. Key themes include how the sessions provided opportunities for artistic development, enhanced (...) mood, reduced feelings of isolation, and sustained and developed community. Particular attention is placed upon how improvisation as a universal, real time, social, and collaborative process facilitates interaction, allowing the technological affordances of software (latencies, sound quality, and gallery/speaker view) and hardware (laptop, tablet, instruments, microphones, headphones, and objects in room) to become emergent properties of artistic collaborations. The extent to which this process affects new perceptual and conceptual breakthroughs for practitioners is discussed as is the crucial and innovative relationship between audio and visual elements. Analysis of edited films of the sessions highlight artistic and theoretical and conceptual issues discussed.
